Smadi went into the building where he conducted his own reconnaissance. ,In late August 2009, while meeting with one of the undercover FBI agents in Dallas, Smadi discussed the logistics and timing of the bombing, stating that he would have preferred to do the attack on "11 September," but decided to wait until after the month of Ramadan, which ended on September 20, 2009. At the conclusion of the meeting, Smadi decided that a vehicle borne improvised explosive device VBIED would be placed at the foundation of the Fountain Place office tower. Alberta chooses its jurors from the provincial motor vehicle registry. It also includes people who might not own cars, but who have provincial ID cards or handicapped placards. It excludes anyone who has ever had any criminal conviction, or who has outstanding criminal charges. If you ever had a criminal conviction, you are ineligible unless you receive a pardon. ,Renouf argues the rules aren't fair, because indigenous Albertans are more likely to be convicted of a crime, and less likely to seek pardons. ,His full argument won't be heard by Justice Brian Burrows until September. And Newborn's criminal trial won't take place until April of 2016. But Monday, Renouf was in court, arguing he needed Alberta Justice to disclose more documents on the way the motor vehicle registry works, and more internal Justice department documents on the way juries are selected. ,Renouf's fight won't be easy. ,In May, the Supreme Court of Canada ruled in a similar case involving Clifford Kokopenance of Ontario's Grassy Narrows First Nation.
